To All:

Your proposed zoning change is prempted by Federal laws and Regulations, and 
will not withstand a challenge in courts.   You do not have the technical 
expertise on staff to enforce the laws because you do not have RF engineers 
who can tell you whether a particiular mode of propagation requires a 
particular size and type of antenna.   You will incur great expense trying to 
defend poorly researched legislation.    

When the great quake comes, and all of the Cities communiations is out of 
service, when the cell phone towers have toppled or collapsed and the local 
phone company is no longer operational then you are going to wish that you 
had some local amateur radio operators to aid in emergency operations.

I suggest that you contact the City of Rushford and the County of Winona, 
Minnesota about the value of amateur radio operators during the disasterous 
flooding of August, 2007.    Rushford had sufficient rain to flood the 
downtown and mush of the outlying areas of town.   The local telephone 
exchange was flooded and out of service.   The cell phone towers were without 
power and not operational and city ogvernment communications were 
non-existent.   Amateur Radio Operators working with the Red Cross provided 
communication into the city.   Amateur Rqdio operators volunteered from many 
parts of the state to come to the aid of Rushford.

My wife Shari, (WA9IGK), spent  nights at the Red Cross Shelters in Winona 
providing
valuable communication.   Amateur Radio was providing road information the 
Emergency Management of Winona County.   This was the only means that 
Emergency Management could get timely information about the conditions of the 
roads.   There were many washouts and collapses.  

 I do not know why you would spit in the face of amateur radio operators who 
by the very Rules of 97 of the Federal Communications Act of 1934 will 
participate and assist in communications during times of civil distress.   
Where else are your going to get free emergency communications?
